Welcome to Merrill Jacobs, Photography and DIgital Artist. These Terms and Conditions (“Terms”) govern your use of this website and any purchases made through it. Please read them carefully before using the site. By accessing or using the website, you agree to be bound by these Terms.
1. About Us
This website is operated by Merrill Jacobs, an independent photographer and digital artist based in Abingdon, Oxfordshire.
2. Use of the Website
- You must be at least 18 years old to make a purchase or commission artwork through this site. 
- You agree to use this website for lawful purposes only and in a way that does not infringe the rights of others or restrict their use of the site. 
- We reserve the right to update, modify, or remove content from the website without notice. 
3. Intellectual Property
- All photographs, digital artworks, images, text, designs, and other materials on this website are protected by UK and international copyright laws and remain the property of Merrill Jacobs. 
- You may not reproduce, distribute, copy, or use any images or content from this site without prior written permission. 
- Purchasing artwork or prints does not transfer copyright or usage rights unless otherwise agreed in writing. 
4. Products and Services
- Descriptions of artwork, prints, and digital downloads are provided as accurately as possible. Colours may vary slightly due to screen or print settings. 
- Limited edition prints are numbered and signed where stated. 
- Digital downloads are for personal use only, unless a separate commercial licence has been purchased. 
5. Ordering and Payment
- Orders can be placed through the website, via email, or at exhibitions and events. 
- Payments are processed securely through Square. 
- You will receive an order confirmation by email once your purchase is complete. 
6. Delivery and Returns
Physical Prints and Artwork
- Orders are usually dispatched within [e.g. 7–10 working days]. 
- UK delivery is made via Royal Mail or courier. International delivery times may vary. 
- If your order arrives damaged, please contact us within 14 days with photos of the damage for a replacement or refund. 
Digital Downloads
- Files are available for download immediately after payment. 
- Due to the nature of digital products, refunds are not available once a download has been completed unless the file is faulty. 
7. Cancellations and Refunds
- You have the right to cancel a physical order within 14 days of receipt, in line with the Consumer Contracts Regulations 2013. 
- To cancel, please contact us via email with your order details. 
- Items must be returned in their original condition and packaging; the buyer is responsible for return postage costs. 
- Refunds will be processed within 14 days of receiving the returned item. 
8. Commissions and Custom Work
- A non-refundable deposit may be required before work begins. 
- The balance is payable upon completion and approval of the final piece. 
- Minor adjustments can be made at no additional charge; substantial revisions may incur an extra fee. 
9. Limitation of Liability
We make every effort to ensure the accuracy and reliability of information on this site, but we do not guarantee that it will be error-free.
 To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of this website or from the purchase or use of our products, except where caused by negligence or wilful misconduct.
10. Privacy and Data Protection
Your personal data is handled in accordance with our Privacy Policy, which complies with the UK General Data Protection Regulation (UK GDPR).
 We only collect information necessary to fulfil orders and respond to enquiries. We never share your data for marketing purposes without consent.
